In response to a story on Babyweb on April 28 2004. Having returned home to Tasmania on April 27 2005, my family and I are now going about putting our lives back together after our unjust experience.

I served the 3 years fixed term of my 7 year sentence, now free having served my time. The remaining 4 years are gone, I serve no parole as I am not in Idaho. I was wrongfully convicted of aggravated battery, for what Idaho authorities say was shanken baby syndrome (SBS) on an 11 month old boy. Fortunately I am now home a free man, with no conviction on my record here in Australia. I was granted parole in Idaho and returned to Australia by US Immigration officials, but despite being extradited from Tasmania in 2003 to Idaho, I was only returned to Sydney, and told to get my own way home to Tasmania. With the Australian Government refusing to assist me in returning to Tasmania.

I plead my innocence to this corrupt conspired charge against me. In my case I expereinced: the prosecutor fabricating evidence, witnesses committing perjury, ineffective court appointed lawyer, unavailable defence witnesses, dozing jurors, biase pre-trial publicity in Idaho, and having no moeny for an adequate defense. The Australian Government provided over 40 pages of documents to the Idaho prosecutor to assist in her prosecution of me (now being investigated by the Australian Privacy Commission).

In the April 28 2004, it claims a number of inaccuracies. Firstly I was not stayiing with a "host family in Idaho while on a basketball tour". I was in Idaho briefly for a business trip, working with local colleges and local charities, at the time owning my own basketball management & marketing company. I visited the mother of the child for a short period, and the local police and the mother (Leann Stephens) accused me of the crime. The mother of the child was given immunity from prosecution in exchange for her favourable testimonty. The mother of the child had committed several crimes of theft, damage to property and fraud. The mother was also blackmailed that if she did not help the police, she could not take her child home.

Secondly, my application to serve my sentence in an Australian prison was DENIED. The Idaho Government took 9 months to process my application and even then they denied it. I only returned home to Australia as I completed my sentence. The Australian Government failed to bring me home, despite willingly extraditing me to Idaho at Idaho's request. The Australian Government let me sit in an inhumane Idaho prison seriously ill with chronic fatigue syndrome and having contracted inactive tuberculosis, 10,000 kms from my family. The Australian Government failed to assist an Australian Citizen and his family, but gladly assisted in the Idaho and US Governments. The Australian Government did nothing to assist me while in Idaho for 2 years, all they did was lie to my family and I, while assisting Idaho.

Since my release from prison I have been able to contact several medical experts from around the world. Thus far 5 medical experts have compiled detailed reports stating the child's injuries are NOT SBS, and the injuries were sustained 3-5 days prior to hospitalization. 3-5 days prior to hospitalization the child was at his grandparents home, where he had been for almost 2 weeks, and where he had had a fall, and been to the doctors during this periiod. All this denied at my trial by the grandparents and mother. The child had yellow bruising on his neck at the time of hospitalization, and you don't need to be a doctor to know yellow bruising is atleast 3 days old to be of that colour. The child had only been in my presence for 20 hours prior to hospitalization. Unlike the prosecutors medical experts at my trial who were paid for their testimony, these 5 medical experts have given their expert opinion for FREE.

Unlike in the Shapelle Corby case, I received NO legal or financial assistance from the Australian Government. My requests for such assistance were continually denied. I am now mounting an appeal against my unjust conviction in Idaho, and again the Australian Government are ignoring me, having not even had the courtesy to respond to my letters pleading for assistance.

There is much to my case that is not known by the public, and I am more than happy to share it with anyone, as I always have been. I welcome anyone to contact me for further information, whether it be regarding SBS, medical issues, extradition, international prisoner transfers, prison conditions or the Australian Government's role in my case.
